A German court just fined a man his full monthly salary for calling Chancellor Friedrich Merz “lying Fritz”. This isn’t a one-off petty incident. It’s a clear sign that governments are tightening the screws on online political criticism, even on major social media platforms.
Heilbronn’s public prosecutor’s office, speaking to German outlet Die Welt, confirmed this is one of 39 initial probes launched last year over Facebook insults against Merz. The cases fall under Article 188 of the German Criminal Code. That law bans insults against public political figures if they’re likely to disrupt their public work. Fifteen of the 39 cases were dropped for lack of evidence.
The insults started after a drone no-fly zone was set ahead of Merz’s October 25 visit to the Heilbronn area. Commenters called him everything from a liar to a “lying clown”, “loose talker”, and “lackey”. Most of these posts, like calling Merz Pinocchio, won’t lead to charges. But the “lying Fritz” comment was a different case.
The court ruled in March that “lying Fritz” was prosecutable. It said the phrase could incite more negative prejudice or aggression among like-minded people. The government spokesman wouldn’t comment out of respect for the judiciary. Merz himself never filed formal charges, and the spokesman called the case a normal legal procedure.
Merz is currently the world’s most unpopular political leader, per recent public surveys. He’s drawn fire for saying the welfare state is obsolete. He also told Germans to work more instead of taking sick leave. His own party is even mulling dumping him over his record-low approval ratings. This case has reignited fresh fears about free speech in Germany.
If this trend spreads across the EU, social media users will have even less room to criticize elected officials online.
